You have a right to request access to your health information and ask for it to be corrected if necessary.

We may charge a fee (as allowed under legislation) for photocopying and sending the information. Our fee structure aligns to Health Records Act 2001, which can be viewed on the Health Complaint Commissioners website. If you would like to request that the fee be waived, please include this as part of your request information.
We need to make sure that we are sending the information to the correct person so you will need to give us a certified copy of your ID (if submitting via email) or show your ID to our staff (if submitting in person).
If you are acting on behalf of a client you need to show us the written consent of the client or demonstrate legal authority (i.e. Executor of the Deceased Estate, court subpoena).
Subpoena or Summons
BHN receives a variety of subpoenas requiring:
- the production of a document or thing
- attendance at Court to give evidence
- attendance at Court to give evidence and produce documents
Production of health records
A subpoena requiring the production of health records should include:
- client’s full name
- client’s address
- date of birth
- which BHN service/s they attended
- the date or timeframe when the client attended the service.
The subpoena should be sent to xxxx.
Attendance at Court to give evidence
A subpoena requiring a staff member to attend court to give evidence should include:
- client’s full name
- client’s address
- date of birth
- which BHN service the client attended
- the date or timeframe when the client attended the service
- hearing date and venue
- direct contact details of the main contact on the matter.
The subpoena should be addressed to the staff member, at their usual BHN work location. It should be delivered in person to the staff member at their usual BHN work location, during business hours.
Before issuing a subpoena, we suggest you confirm that the individual is still employed at BHN by contacting xxxrole
If your subpoena involves staff working in Family Violence, please speak to xxxrole before issuing any subpoenas.
Please respect the clinician’s time and take all reasonable steps to minimise disruption to the workplace, which will be caused by their absence to attend court.
Contact the staff member the week prior to the hearing, and again on the day prior to the hearing, and confirm that attendance is still required. This avoids the worker attending Court (or the Tribunal) unnecessarily, for example, where the case has been adjourned or has settled.
Please note that you may include a requirement to produce the staff member’s own notes. Should you require extensive notes, you will need to arrange a separate subpoena.
Witness Fees may be charged for staff members’ time, invoices will be issued after any appearance depending on the duration of the appearance. ‘Conduct money’ is required prior to the staff person attending the court or hearing.
How to service a Subpoena or Summons
When serving a subpoena on BHN, ensure you provide reasonable notice (preferably at least two weeks), to enable BHN to comply.
The subpoena must be:
- Stamped by the Court;
- Addressed correctly;
- Include sufficient conduct money; and
- Delivered to BHN by 4pm on or before the last date of service

Production of employee records
It is recommended that you take a copy of any important documents from Connx prior to finishing in your role at BHN.
A subpoena requiring production of employee records should include:
- employee’s full name
- employee’s address
- employee date of birth
- the relevant period of employment
